2013 Arbitral Tribunal. On 22 January 2013, the Republic of the Philippines instituted arbitral proceedings against the People’s Republic of China under Annex VII to the United Nations Convention on the Law of the Sea (the “Convention”). The arbitration concerned the role of historic rights and the source of maritime entitlements in the South China Sea, the status of certain maritime features in the South China Sea, and the lawfulness of certain actions by China in the South China Sea that the Philippines alleged to be in violation of the Convention. China adopted a position of non-acceptance and non-participation in the proceedings. The Permanent Court of Arbitration served as Registry in this arbitration..

MANILA , 30 MAY 2022 –The Department of Foreign Affairs (DFA) has filed a diplomatic protest against the People’s Republic of China’s 01 May 2022 unilateral imposition of a three-and-half-month fishing moratorium in areas of the South China Sea north of the 12 degrees North latitude. The fishing ban is expected to last until 16 August 2022 . In a diplomatic note dated 30 May 2022, the DFA conveyed its protest to the moratorium, which covers areas in the West Philippine Sea over which the Philippines has sovereignty, sovereign rights, and jurisdiction.  Paragraph 716 of the final and binding Award on the South China Sea Arbitration rendered on 12 July 2016 states that China, by promulgating its moratorium on fishing in the South China Sea “without exception for areas of the South China Sea falling within the exclusive economic zone of the Philippines and without limiting the moratorium to Chinese flagged vessels, breached Article 56 of the 1982 United Nations Convention on the Law of the Sea (UNCLOS) with respect to the Philippines’ sovereign rights over the living resources of its exclusive economic zone.”  The  DFA reiterated its continuing protest of China’s annual practice of declaring a fishing ban over areas that extend far beyond China’s legitimate maritime entitlements under the 1982 UNCLOS. The declaration of a moratorium on fishing that extends to the West Philippine Sea has no basis in law, and undermines the mutual trust, confidence, and respect that should underpin bilateral relations, as affirmed most recently by President Rodrigo R. Duterte and President Xi Jinping during their Telesummit on 08 April 2022. The  Philippines calls on China to comply with its obligations under international law, particularly the 1982 UNCLOS and the final and binding Award on the South China Sea Arbitration; cease and desist from the conduct of illegal actions that violate the Philippines’ sovereignty, sovereign rights, and jurisdiction in its maritime zones; and adhere to its commitments under the  2002 Declaration on the Conduct of Parties in the South China Sea (DOC). Sanhi : On  22 January 2013  the Philippines initiated international arbitration against the People's Republic of China (China) regarding its territorial and maritime dispute in the South China Sea – known as the West Philippine Sea in Manila. The   arbitration case between the Philippines and China  over the West Philippine Sea seeks to clarify the geographical extent of the dispute by requesting the Tribunal to rule on the validity of China's nine-dash line, and determine the legal status of specific features including the maritime zones that they can ... Epekto : Rivalry between China and Philippines and other major players in the South China Sea may increase. The South China Sea is not only a dispute about territorial claims and maritime demarcation between a few claimant states. It is also directly relevant to the security structure and regional architecture in the Asia Pacific. Any conflict or tension in the South China Sea is likely to prompt a U.S. reaction; otherwise the United States’ predominant position, its security commitments, and its regional security role would be significantly damaged. There is no evidence that the United States is prepared to adopt a weaker position or policy in the South China Sea anytime soon. In fact, the arbitration may intensify U.S. involvement in the South China Sea. China  will likely encounter serious diplomatic challenges in the aftermath of the arbitration. In the past few years, many Southeast Asian countries’ concerns about China’s policies in the South China Sea have grown. The arbitration will not help resolve the South China Sea disputes, especially the core issues involving territorial sovereignty and maritime demarcations. In the short run, there is likely to be a period of greater turbulence once the tribunal’s decision is known. The extent of conflicts and tensions may depend on the actual ruling by the judges. There will be challenges for all parties concerned, but China may have to face more difficulties than any other country after the arbitration. The major challenge for China will be how to balance its strategic, security, political, and economic interests in the Asia Pacific and beyond with its territorial and maritime interests in the South China Sea.  Solusyon: The first solution is diplomacy, the solution that has been always on the negotiation table between the Philippines and China: that is, joint exploration of the Scarborough Shoal while shelving the dispute on sovereignty. But even here, the two countries can go further than a minimalist solution. They can agree to develop the disputed waters into a jointly administered ecological and biological exploration station that allows scientists from both countries and beyond to explore life beneath the South China Sea, and an eco-friendly tourism site that allows people from all over the world to experience the beauty of the South China Sea . The second solution is more radical and thus more path-breaking. This solution is for the Philippines and China to mutually recognize each other’s sovereignty claims over the Scarborough Shoal, in addition to the bargain proposed in solution one.
