[Audio] Facts of the Case "Adam Cute" and " Jeany Gwaps" are public school teachers in Cagayan de Oro City. They were FB friends since they work in the same school, but they were only colleagues and not friends. Their conversations are limited to work matters..

[Audio] Sometime in July 2020, during Covid – 19 pandemic, Adam Cute decided to send a personal message to Jeany Gwaps via Facebook messenger. The message was "hi cher" (verbatim)..

Facts. Jeany Gwaps , without malicious intent, replied considering that the questions were work-related. However, in the succeeding days, Adam Cute still continuously sent messages to Jeany Gwaps though the topics nor questions were already non-work related..

[Audio] One of Adam Cute's notable chat was this: ( non-verbatim) " Naa mi ride diha Dahilayan, hapit mis inyoha para mangape or inom ug tubig." Though, this never happened..

[Audio] Despite their exchange of messages, they were still not close with each other in person..

[Audio] On his defense, Adam Cute claimed that he was just "Being Friendly". Jeany Gwaps doesn't think so. Thus, this petition..

[Audio] Issue: Whether or not Adam Cute was just "being friendly".

[Audio] Ruling: The Court ruled in negative. Adam Cute was not just "being friendly. When he initially messaged Jeany Gwaps with "hi cher", including those subsequent messages and their exchange of pleasantries virtually and personally at work, he was testing the water and checking if Ms Jeany Gwaps could be a suitable girlfriend, well-capacitated to observe mutual love, respect and fidelity, and render mutual help and support..

Ruling:. However, petition was filed two (2) years later and both parties since then have grown to love and respect each other, and therefrom entered into a committed relationship (see Exhibit A). The determination therefore is immaterial. WHEREFORE, in view of all the foregoing, the petition is hereby declared moot and academic. SO ORDERED..
