A notary signing agent is a notary public who has been trained in handling loan documents. Lenders and title companies hire contracted agents as independent contractors to assist in the final step of the loan process.

The duties of a notary signing agent generally include printing loan documents, meeting with the signatory and certifying their signature, and returning the documents for processing in a timely manner. The NSA is also responsible for following additional instructions from lenders, title companies, or signature services that hire them for loan settlement. For example, the NSA may be required to fax the document immediately or use a specific mail service to return the document securely.   Since the contracted agent of the notary can access the borrower's private financial information and send it to the customer's home, the mortgage finance industry requires all contracted agents to conduct background checks every year. This helps prevent mortgage fraud and ensures the security of consumer information.

Notary signing agents are independent contractors and decide how much they charge for signing services. As a contractor, a hired agent generally charges a fee for each task, ranging from $ 85 on the low scale to $150 dollars on avg per signing. $150x5 =  $750 a DAY!  The amount you earn will depend on how many jobs you can complete in one day.   Other factors that affect the cost of the task are the hiring company, whether you work for a lender or escrow office, and your budget. In addition to the notarization fee required by state law, the contracting agent may also charge express service fees, including printing and delivering the entire loan package to the contracting company. All fees must be agreed upon before signing.

There are many advantages to being a notary signing agent. The first is the opportunity to earn income. The fee you can charge for processing the loan package is separate from the fee for regular notarization, which means you will have more income each time you distribute. The second advantage is that you can be your own boss. Since the notary signing agent is an independent contractor, you will control their working hours and decide how many notarizations will be performed during the day.   If you have been appointed as a traditional notary, then you are one step closer to becoming a notary's signature agent. If you are not currently a notary public, you will need to meet eligibility requirements and comply with your state's regulations regarding signing agents.

The best way to prepare to become a notary is with the guidance of the NNA (National Notary Association) https://www.nationalnotary.org/   You can search your particular state and they will direct you with the steps needed from requirements, commission application, notary state handbook, and supplies like your stamp to conduct signing. Please note that to obtain your supplies you will have to show proof by email of your commission from your state before they will mail out the stamp portion of your notary supply package. Email to  Releasing@NationalNotary.org   Notary Signing Agents (NSAs) facilitate loan closings for the mortgage finance industry. Before starting the NSA certification process, you must be commissioned as a Notary Public. Please be aware that opportunities to conduct loan signings may be  limited or restricted in some states .

Signing Agent Certification Process:  Many state laws do not address additional qualifications or requirements for Notaries who work as Notary Signing Agents. However, companies in the mortgage finance industry do have laws and regulations they must meet in order to do business. Because lenders, title companies and signing services are held to certain regulatory standards, they set the bar for the Notaries they hire. While every company's guidelines may vary, the industry strongly recommends taking all of the following steps to increase your chances of getting hired by the widest range of companies. Be commissioned as a  Notary Public in your state  (required). Take a loan signing training course. Pass an exam and background screening that are  SPW compliant . Buy your Signing Agent supplies. Purchase a minimum $25,000 E&O insurance policy. Start working as a Notary Signing Agent. Promote your business online by joining Notary Signing Agent directories.

Step 1:  Ensure that you are eligible to become a Notary and in compliance with state requirements: Be atleast 18 years old Must be goof of character, integrity and abilities          Step 2:  Purchase my state-required supplies at NNationalNotary.org/MD/Become or call 1-800-876-6827. The NNA* will immediately ship the supplies that are not dependent upon the commission (ex. journal, law primer, etc., as required).         Step 3:  Complete your application at  http://www.egov.Maryland.gov/sos/notary/#/new . Be sure to have the information for three references (not family members or your employer) and a digital image of your driver license or valid government issued   .

Step 4:  The state will send my commission certificate to the clerk of the circuit court  in your country along with a postcard directing you to appear at the clerk’s office within 30 days. An appointment fee will apply.      Step 5:  To receive my stamp, scan and email a copy of my commission certificate to  Releasing@NationalNotary.org  or fax to 1-800-833-1211. Be sure to include my NNA customer number. Once documents have been received, my stamp will be shipped within 3 business days.

The following states have restrictions that Notary Signing Agents should adhere to

Once you receive your commission in most states you can  become a loan signing agent.  However, some states have restrictions. Here are some state restrictions: Connecticut :  Prohibits out of state attorneys and non-attorney Notaries from conducting closings for most mortgage loans in Connecticut. This excludes home equity lines of credit, other transactions that don't require the issuance of a title insurance policy, and property located in other states. Delaware:  Requires an attorney admitted to the state bar to be present or involved in the closing of real property transactions. Georgia:  Requires an attorney admitted to the state bar to be present or involved in the closing of real property transactions Indiana:  Requires a title insurance license for all closings. Maryland:  Requires a title insurance license for all closings

Massachusetts:  Requires an attorney admitted to the state bar to be present or involved in the closing of real property transactions. A Notary who is employed by a lender may notarize a document in conjunction with the closing of his or her employer's real estate loans. Minnesota:  Requires a closing agent license. Nebraska:  Limits the  fees Notaries may charge  (to the statutory maximum fees for notarial acts only). No ancillary fees, such as a courier fee, may be charged. Nevada:  Limits the fees Notaries may charge (to the  statutory maximum ). These fees include an hourly travel fee based upon the time of day traveled. New York:  Certain companies providing assignments to signing professionals may choose to only use licensed attorneys. North Carolina:  Limits the fees Notaries may charge (to the  statutory maximum fees for notarial acts ). No other ancillary fees may be charged. South Carolina:  Requires an attorney admitted to the state bar to be present or involved in the closing of real : property transactions.

South Dakota:  Authorities conflict about whether Notary Signing Agents can conduct signings without being an attorney. Texas:  Home Equity Line of Credit (HELOC) loans are subject to  Article XVI, Section 50 of the Texas Constitution . Title 7, Section 153.15 of the Texas Administrative Code, clarifies that the closing must occur at the permanent physical address of a lender, an attorney, or a title company. This includes an indoor office or a parking lot. Starting on January 1, 2022, wrap mortgage loans may only be closed by an attorney or a title company. A wrap mortgage loan is a residential mortgage loan that is (a) made to finance the purchase of residential real estate that will continue to be subject to an unreleased lien that attached to the residential real estate before the loan was made and secures a debt incurred by a person other than the wrap borrower that was not paid off at the time the loan was made, and (b) obligating the wrap borrower to the wrap lender for payment of a debt the principal amount of which includes the outstanding balance of the debt and any remaining amount of the purchase price financed by the wrap lender.

Utah:  House Bill 47 , clarifies the performance of notarial acts by a Notary, the receipt or delivery of a document, and the receipt of money for delivery to the escrow agent for the transaction does not require an escrow license. Prior to House Bill 47, Utah's insurance code restricted Notaries from handling funds without an escrow license. Vermont:  Requires an attorney admitted to the state bar to be present or involved in the closing of real property transactions. Virginia:  Restricts Notaries from conducting real property signings without an escrow license.  West Virginia:  Requires an attorney admitted to the state bar to conduct the closing of real property because these transactions are considered practice of law.

The terms "Notary Attorney State" or “Real Estate Attorney state" are commonly used when referring to which states require a lawyer at closing for real property transactions. These deals involve legalese that may be difficult for borrowers to understand and if a title agent, escrow officer or Notary Signing Agent provides explanations, it could be considered the unauthorized practice of law. In attorney closing states, lawyers serve as a third-party to ensure the legal requirements of the purchase are met, and that the interests of both the buyer and seller are protected. While an attorney must be involved, a Notary Signing Agent still handles the notarization part of the process. The primary difference for Notary Signing Agents who work in an escrow or an attorney state is whether they are hired and how. Companies in escrow states typically use independent Notary Signing Agents for home loan closings. However, in attorney states, in-house staff Notaries usually handle notarizing during the mortgage closing process.

Training is not mandatory but strongly recommended as it can help you pass the Notary Signing Agent exam. Instead of spending hours researching topics on your own, an online training course can provide you structured education to assist with the learning process. On a broader level, getting a training certification assures companies you've been properly instructed on how to perform loan signings, how to prevent mistakes and how to answer questions about loan documents. As a third-party service provider, NSAs can become a liability to themselves, and their contracting companies should a signing go south. Companies need to be assured you've been professionally trained in all matters of a home loan closing and can provide consistently excellent customer service in each signing. A training course can typically be completed within a few hours. The length of the Notary Signing Agent exam will vary based on the company you choose to get certified with. For example, the NNA Notary Signing Agent exam consists of 45 multiple-choice questions.

What does a Notary Signing Agent do? A Notary Signing Agent is a Notary who is specially trained to handle and notarize loan documents. For lenders, Notary Signing Agents are the critical final link to complete the loan. A Notary Signing Agent is hired as an independent contractor to ensure that real estate loan documents are executed by the borrower, notarized and returned for processing on time. Completing this critical part of the loan process enables the loan to be funded. Who can become a Notary Signing Agent? Anyone who meets the requirements to be a Notary Public in their state can go on to become a Signing Agent. However, it is important to note that some states have restrictions that apply to NSAs. Is certification required? Certification is not required by law to become a Signing Agent. However, many companies that contract Signing Agents for mortgage closings ask these professionals to be certified and background screened in order to meet Consumer Financial Protection Bureau  compliance requirements  for third-party service providers hired by financial institutions. In order to guard borrowers' private financial information, the mortgage industry requests all persons involved in the lending process to undergo background screenings. Lenders in turn instruct title services companies to ensure that everyone with access to mortgage documents has been screened. This applies to everyone handling loan documents including Notaries who act as Signing Agents. Are there any special requirements or restrictions in my state? It depends on the state. A Signing Agent must be a commissioned Notary Public. Some states limit or restrict Notaries from working as Signing Agents or include additional licensing requirements. NSAs who follow the recommended industry certification process listed above can expect one to two weeks to become a certified Signing Agent. Most of this time will be spent waiting for your background screening results to return.
