[Audio] 第一部分係關羽藥劑製品嘅分類，第二部分係關於藥物注冊。首先，目想同大家講解關於衞生署嘅藥劑製品分類指引 旨在提供一般原則同建議 以便業界決定產品屬唔屬於藥劑製品。至於有關先進療法製品 advanced therapy products 嘅歸類指引 大家可以瀏覽以下網址。.

[Audio] 我地先簡單了解一下香港嘅藥品監管制度。香港藥物監管制度由三個部門及組織組成： 一，香港藥劑業及毒藥管理局 香港藥劑業及毒藥管理局 (Pharmacy & Poisons Board) 係根據香港法例第138章《藥劑業及毒藥條例》成立嘅法定組織，主要負責執行《藥劑業及毒藥條例》同埋相關嘅附屬法例規定。 具體職能包括: 一，藥劑師嘅規管 包括處理藥劑師註冊事宜 例如係訂明註冊所須嘅訓練、主辦註冊考試、簽發註冊證明書及週年執業證明書等; 以及委出紀律委員會，調查藥劑師嘅行為操守，並懲處被裁定行為不當嘅藥劑師。 二， 規管藥劑製品嘅製造、批發、零售，及簽發相關牌照 有關工作包括進行巡查同試買行動、提出檢控，同埋委出紀律委員會調查獲授權毒藥銷售商嘅經營手法等。 三，規管藥劑製品嘅銷售、購買、合成(亦即compounding)同配發(dispensing)嘅事宜，以及 四，處理藥劑製品嘅註冊同分類事宜。 組成香港藥品監管制度嘅第二個組織係醫務衛生局 醫務衛生局 （前身食物及衞生局) 係香港特區政府決策局，主要職責係負責藥物政策制定 而第三個組織就係衛生署 衛生署係醫務衛生局轄下嘅部門，負責具體行政同執法工作，包括領導有關公共衛生嘅執法，以及制訂各項規管策略。而藥物辦公室係衛生署轄下嘅服務之一，負責執行第138章 藥劑業及毒藥條例以及其他與藥物有關嘅法例。.

[Audio] 根據《藥劑業及毒藥規例》第138A章 即《藥劑業及毒藥條例》第138章既一條附屬法例，藥劑製品必須先向藥劑業及毒藥管理局註冊，先可以响香港銷售、要約出售或分銷，或為左銷售，分銷或其他用途而管有。.

[Audio] 起審批藥劑製品嘅注冊申請時，我地會審核製品係咪符合安全、療效同素質方面嘅標準，只有三方面都達標嘅製品先會獲得註冊。.

藥劑製品歸類及管制 Classification & Control of Medicine. 第一類 Category 1 只可按照註冊醫生所簽發的處方在註冊藥房配發及銷售 must be dispensed & sold on doctor’s prescription in registered pharmacies 第二類 Category 2 由註冊藥劑師或在其在場監督的情況下在註冊藥房銷售 to be sold in registered pharmacies under the direction & supervision of registered pharmacists 第三類 Category 3 HK-34567 須加上標籤標明 labelled with “Drug under Supervised Sales 監督售賣藥物” 可在註冊藥房或藥行銷售 can be sold in pharmacies or medicine stores without resident pharmacists HK-23456 須加上標籤標明 labelled with “Prescription Drug 處方藥物” HK-12345.

問題 Question:. 什麼是「藥劑製品」? What is a “pharmaceutical product” ?.

藥劑業及毒藥條例 (PPO) Pharmacy & Poisons Ordinance (PPO).

決定產品是否藥劑製品的相關因素Deciding Factors. 有關物質或物質組合是否存在於該產品； Substance or combination of substances is present in product; 有關物質或物質組合是否藥用； Substance or combination of substances is medicinal or not 藥劑劑型形式（即膠囊、片劑等），以及其使用的方法； Pharmaceutical dose form (i.e., capsule, tablet, etc.) & way to be used; 標籤、包裝／說明書、宣傳品上所標示的用途； Use(s) on label, package, insert & promotional materials 是否有任何在實質上類似的藥劑製品在香港註冊；以及 Any essentially similar pharmaceutical products registered in HK; 該產品會否對公眾造成任何風險。 Product may pose any risk to the public..

有關物質是否“藥用”? Is the substance “Medicinal”?. 有關物質列載於 Substances listed in the： 毒藥表 (Cap. 138A, 附表10), Poisons List (Cap. 138A, Sch. 10) 抗生素規例 (Cap. 137A), Antibiotics Regulations (Cap. 137A) 危險藥物條例 (Cap. 134) Dangerous Drugs Ordinance (Cap. 134) 某些有效成分如已存在於註冊藥劑製品， 則可推斷該成分為藥劑製品 / 物質。 active ingredients found in registered pharmaceutical products are good indications as pharmaceutical products / substances.

有關物質是否“藥用”? Are the Claims “Medicinal”?. 聲稱有關 Claims related to: 治療或預防疾病 treating or preventing disease 恢復 restore, 矯正, 或 correct, or 改變 modify 人類或動物的生理機能 physiological functions in human beings or animals.

與醫療聲稱相關聯的例子 Examples of “Medicinal” Claims. 預防心臟病 Prevents heart disease 花粉熱藥物 Remedy for hay fever 經常使用可抵抗傷風感冒 Frequent use can fight cold and flu 預防骨質疏鬆症 Prevents osteoporosis 頭虱治療 Headlice treatment 治療口腔潰瘍 Treats mouth ulcers.
